Right of withdrawal
In accordance with Articles L.121-21 and L.221-18 of the French Consumer Code, you have a right of withdrawal to exercise within fourteen working days from the date of receipt of the item. You do not have to provide any justification or pay any penalties, apart from the return shipping costs.
The right of withdrawal does not apply to products made according to your specific instructions or to personalized products. Products that are perishable by nature, cannot be returned, or are liable to deteriorate are also excluded from the right of withdrawal.
Return the product within the aforementioned period. Within the same timeframe, please inform us of your decision to withdraw from this contract by mail to the following address: Hôtel Byblos, 20 avenue Paul Signac, 83990 Saint-Tropez, France, or by email to eshop@byblos.com.

The merchandise must be returned to the following address, with return shipping costs at your expense: Hôtel Byblos, 20 avenue Paul Signac, 83990 Saint-Tropez, France.

To ensure that the returned product is resalable, you agree to return it to us in its original packaging and in perfect condition.

Warranty and Right of Return (Hidden Defect or Malfunction)
LE BYBLOS SAS is liable for defects in conformity of the goods to the contract under the conditions set forth in Articles L. 211-2 et seq. and 217-1 et seq. of the French Consumer Code, and for hidden defects in the goods sold under the conditions set forth in Articles 1641 et seq. of the French Civil Code.

Please note the following:
- You have two years from the date of delivery of the goods to take action by submitting a claim;
- You may choose between repair or replacement of the goods, subject to the cost conditions stipulated in Article L. 211-9 of the French Consumer Code;

1 – You are exempt from providing proof of the existence of a lack of conformity of the goods during the six months following delivery (this period is extended to twenty-four months from March 18, 2016, except for second-hand goods).

2 – The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

3 – You may choose to invoke the guarantee against hidden defects in the goods sold, as defined in Article 1641 of the French Civil Code, and in this case, choose between rescinding the sale or obtaining a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

LE BYBLOS undertakes to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.

The manufacturer is also liable for defects in conformity resulting from packaging, assembly instructions, or installation when the latter was its responsibility under the contract or was carried out under its supervision.

The warranty applies to our products that are defective (lack of functionality, product unfit for its intended use, absence of features presented online, partial or total malfunction, product failure), even in the absence of a contractual warranty.

In the event of a lack of conformity, we undertake to:

– Repair the product within 30 days at no cost.

– In the event of a failure to fulfill our obligation or in the event of a major defect, we undertake to refund the full price paid or a portion of the price if you wish to keep the product.
The presumption of a lack of conformity no longer applies if it appears more than 24 months after the sale. You must provide proof of the defect in our product.

In the event of a hidden defect in your product, you are covered by the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. This applies to all our products. This guarantee applies when the defect renders the product unfit for its intended use or when it reduces its usability to such an extent that you would not have purchased it or would have paid a lower price. The guarantee against hidden defects only applies when the defect existed prior to the sale. You have two years from the discovery of the defect to take action. In the event of a defect, you may choose between rescinding the sale or obtaining a price reduction, in accordance with Article 1644 of the French Civil Code, unless you express a preference for a product replacement.

Refund Conditions and Timeframes
Product refunds are full, except for the aforementioned price reduction. It is made by bank transfer as soon as possible and at the latest within 30 days from the date of exercising the right of withdrawal.
